The T&C spiel when you talk to an agent to upgrade to FTTC, and in the confirmation ticket says "Your estimated line speed is 40mbps, however this may vary due to the distance from your exchange, quality of your phone line, traffic prioritisation and management policies amongst other factors."
Surely this should now be distance from your cabinet for FTTC?

Sounds like a standard common response is being used inherited from ADSL

Same as the 10 day thing for 'speeds to settle'.
If your line does not sync anywhere near your estimates when you're first connected, then it's not suddenly going to improve!
