Yes.
PLUSNET should not give out anymore names until they get the answers to the question i posed in the first post of this thread.
How many Plusnet subscribers have been sent letters of claim and how many of these have been taken to court...........let me guess NONE

Technically if PlusNet have passed your details onto a thrid party without your permission i.e. ACS then your contract with PlusNet is nul and void immediately.  ACS is not a credit reference agency where you gave permission to allow Plus Net to do a check.  A "Subject Access Request" sent to Plusnet will iform you if your detaisl ahve been submitted to ACS.  The cost for thsi service is £10.00 and should include  statements, copies fo telephone conversations, every question you have raise, every note made about your account and thsi includes emails and infomation sent to any third party.  failure by Plusnet to supply this within 40 days can resutl in an extremely large fine being handed out.
Perhaps Plusnet would like to comment on the above?

Plusnet would have a get out of jail free card.
If the information would require an unreasonable amount of time & effort, then they can refuse.
However, if you just asked for all correspondence etc relating to your account and external agencies (non-BT), then I would expect them to comply.

Can Plusnet Tell us if they have received the information from ACS Law yet. As we all know how slowly the wheels of Law turn, it might be a good idea to write to them reminding them of their obligation to provide you with a list of your subscribers, from the many that you have provided to them, that have been taken to court by ACS Law.
I also note that a new batch of Letters have been issued in the last couple of weeks, can PLUSNET confirm they have not given any names or adresses to ACS Law regarding this latest NPO (Norwich Pharmacol Order) or Court order. I know that many of them are addressed to BE unlimited but I do not know who proved the rest of the names.

Yes and as I said earlier, I will not let this drop until WE get a satisfactory answer from PLUSNET. They have a duty of care to protect our Personal Information from Unscuplious Scam artists like ACS LAW. (Please note that this is a personal opinion) Wink

I have seen the new 'order' and whilst it is a shorter list of ISP's than before  BT and Plusnet are on there, perhaps as its easy pickings  Angry
Other ISP's appear to have refused this time round  Huh

They probably reason (falsely) that anyone targeted by ACS must be a heavy downloader and that they could save money by stitching people up.
I thought that some law or other got "washed" through parliament a couple of months ago?
Has it been repealed?

Thanks for the reply, however it is now over a month since I posted my original question, with no answer. All I am requesting is that PlusNet exercise their right and request the information from ACS LAW. This is only the price of a stamp or telephone call, as they MUST Provide the information as per the Court order.

I believe ACS have until the end of June to instigate court action?
So we must wait at least a few weeks.
The legal system grinds extremely slowly. Roll_eyes

Thats not quite correct  Smiley ACS Law have to produce a report for PlusNet showing how many people they have taken to court, from the Hundreds of names given to them by PlusNet before the end of Jun. (as stated on the NPO (Court order) dated 15 Nov 09). I am betting that the total will be ZERO.

Keep up the good work Dave.
I have never had any letters but I would be angry if they just gave out my details without any proof.
So if they do not supply the information by the end of the month have they broken the courts ruling or have Plusnet run out of time to request it?

yep i would like that clearing up to, is the time period for PN to put a request in or do acs have to give this information automatically  to pn in this time frame just on the clauses in original  order
