If your details have been disclosed in the past (ie prior to the Nov 09 NPO) then you would have received communication from the law firm in question.

So by that I can assume that if we've never had a letter of accusation by then, you won't of given away our details yet since then?

Seems like a very bold statement to me Mand.  How do you know this to be true?

Prior to the November 09 NPO it was a different law firm (Davenport Lyons) handling the requests. Davenport no longer deal with this sort of case.

We don't allow confidential information to be leaked all over the place.

Hate to say it Mand but you did a pretty good job of disallowing it then.

I suspect that is a bold assumption

So how can you be sure the data would not still be used and people get letters from that data?

Fair enough, I see what you are saying but could they have passed the information on again?

Thats an interesting aspect.
For those in the know, is a company who has obtained data from an NPO compelled to go ahead an contact the alledged copyright infinger? I assume the answer must be Yes because the point of the NPO is that they claim to have enough evidence to prosecute and plan to do so. So does ACSLaw have a long list of names and addresses from an NPO which they have not contacted? If so then they are again clearly not using the NPO for the purpose it was meant for and is further evidence of the ulterior motives they may have for requesting the NPO.

Even though PN are saying they are looking after and doing everything for the customers that details were leaked, it doesn't seem true.
All I have had in support tickets is non-chalant vague answers and then a cold blatant admission of guilt, yet have i to receive an apology for the lack of duty of care this company should have had for my custom.

Errr, yes.... BUT
1) a new company has surfaced who appear to be using DL's old lists, letters to some people have just started arriving
2) You forget that the evidence etc belongs to the client (the copyright holder) not the solicitor, just because a solcitor drops out does mean not the client cant get another one in the future and resume (see point 1).

Re: Plusnet will give your personal details to ACS Law with not informing you!!

So Mand, can you tell us whether all people whose details have been provided to law firms since the Nov 09 NPO have been notified by you?
If not, how can your customers find out?

Re: Plusnet will give your personal details to ACS Law with not informing you!!

I don't think that could happen fourfourdevon, even if you did get a letter from Davenports old list then you could easily contest it by asking your ISP when the request was made.
If it was longer than 6 months ago then they have absolutely no case at all. All data essentially should be destroyed if not processed after 6 months.

And that makes having my details in the public domain open to identity theft alright?
