Quote from: fourfourdevon It's not ACS:Law's application it "someone insert correct law firm name for me", but they are using essentially the same court rules, court orders, letters, detection methods etc etc I'd be stunned if that hadn't at least partially made it into CMW conciseness.
Yeah sorry, a small lapse of thought there. I think it's Gallant McMillan this time.

Quote from: watching There NEEDS to be something more comprehensive on the position re. Monday.
To prepare for this on Friday - the last working day before it's back in court - is TOO LATE.
[Moderator's note by Adie (Adiewoo): Full quote of preceding post removed, as per Forum Rules ]
I meant to collate all the important bits of this thread together.
The hearing on Monday is way above my pay grade, so I don't have any specific preparation to do for that.

Mand, at your pay grade can you assure us that someone at the correct pay grade is making adequate preparations?
If they're not - they're on the wrong pay grade.
Edit: Correction of Mand's name

Secondly, the pay grade comment was a light hearted way of me saying I've asked the question internally and discussions are being had.
I do not know the answer as to who is preparing, or what representation there will be, but I am aware that this is the biggest remaining important point to be answered in this thread.
Rest assured, when I know the answer, so will you.

If you read from page one of this thread you will see the same sort of requests being made to plusnet time and time again and they never turned up and even agreed with the order long before the court case was due.
They may have already agreed not to contest the Monday case some time ago.
I would love to be proved wrong so come on Plusnet do it.
Today is Thursday if you don't have it all in place to attend today you won't make it even if you wanted to.

Well, if they win on Monday we'll find out if their threat to 'follow through' with court cases. If they do and the cases fail then a powerful precedent will be set, as it will if they win of course.

Perhaps they should find out who runs the topsites if they were bothered about Piracy, no, it's simply a cash generation shceme by mis-using a well intentioned but badly written piece of legilation.
Asking 'Mr Smith' for £500 after downlaoding debbie does dallas does not tackle piracy.

Which just aint true.
Quote Games firm Topware Interactive won an out-of-court settlement of £16,000 following legal action against Londoner Isabella Barwinska who shared a copy of the game Dream Pinball.
The case was won by default in court, the alleged "Isabella Barwinska" has never been found, who she is, where she is, or how come NOBODY has ever been able to trace her remain a mystery. Given the levels to which these people stoop I would not be surprised to learn she was a fiction invented just in order to get a judgement they could wave in peoples face.
And as the ACS:Law emails reveal the default win would almost certainly be reversed if one of the money grabbing, bullying solicitors actually took a case to court where someone actually contested the case, even if they pleaded guilty, the almost certain maximum that would be found against them would be the copyright owners take of the price of 1 copy of whatever work they pleaded guilty over. Blackpool trading standards have advised that for music the appropriate amount to pay is £0.75 per track.
The "Isabella Barwinska" case almost certainly has no bearing what so ever on any other case.
I am utterly disgusted by the lies of these utter slime balls.
